The SCOTUS Leak
I am pretty certain that this is a leak and not a hack. Why? A hack would not have involved just one document. A hacktivist would do things like show the private email correspondence of the judges he dislikes. The release of a single draft decision suggests someone with privileged access who does not want to release so many documents that it gives a clue to his identity (for example, if he released emails someone might figure out who it is from the one email address that was always present in the receiver, CC, BCC, or sender fields).
My guess, it is one of Sotomayor's law clerks. I think I know which one too, but I don't want to risk falsely accusing someone publicly. Christ, I am so proud of my deduction, but I just can't do it.
By the way, the theory that it was a conservative is absurd as the law firms that hire conservatives are likely to shun anyone who breaks the long-standing tradition of court confidentiality. The person leaking it is hoping the backlash results in someone defecting. The idea that certain outlets have put forward—that this leak was done by conservatives to "prevent votes from defecting"—makes no sense.
What is more likely, that the shame of defecting from a pro-life vote keeps one from doing so or that the hassle of having protestors show up at your home and harass you and your family gets you to switch? I have the sneaking suspicion that the left is going to target whatever justice is rumored to be most on the fence, or most susceptible to intimidation. Kavanaugh could be their target. After all, he probably wants to cultivate a feminist image in order to blot out the controversy surrounding his nomination.
I doubt anyone wants to start a betting pool over who it was, but if you do I promise to keep you anonymous.
