Justice Breyer Retires: Biden's Courses of (Affirmative) Action
Part of me wishes Biden would appoint Merrick Garland, not because he would be a good justice but because he would do less harm on the SCOTUS than he is currently doing being the most ruthless and unethical Attorney General we have had in living memory: And, of course, he would not be much worse than whoever he does end up appointing.
Let's hope to God he doesn't appoint Anita Hill just to dredge up that old set of lies and, possibly, make life so uncomfortable for Justice Thomas that he retires: It is a nasty move, and I sort of hate myself for even thinking of it, but it is a possibility despite her lack of qualification.
That said, it will probably be the justice from the California Supreme Court, Leondra Kruger: She has the best academic background of the candidates on the short list, and Biden will want some who cannot be opposed on the grounds of insufficient academic qualification given his narrow senate margin. That is my official guess.
I am making a rational actor assumption here, which could be questionable given his mental state.
